Please read these Terms of Service ("Terms") carefully before using the rentomycar.com website and related services operated by RenToMyCar ("RenToMyCar", "we", "us", or "our"). By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Platform Overview

RenToMyCar is a peer-to-peer car rental marketplace that connects vehicle owners ("Hosts") with individuals seeking to rent vehicles ("Guests"). RenToMyCar acts solely as a platform facilitating these connections and is not a party to the rental agreement between Hosts and Guests. RenToMyCar does not own, operate, inspect, insure, or control any vehicles listed on the Platform.

2. Eligibility

• You must be at least 18 years of age to use the Platform.
• Guests must hold a valid driver's license issued in their state or country of residence.
• Hosts must be the legal owner or authorized representative of any vehicle listed.
• You must provide accurate and truthful information during registration and booking.

3. Guest Responsibilities

• Guests must operate rented vehicles safely and in compliance with all applicable traffic laws.
• Guests are responsible for any traffic citations, parking tickets, or toll violations incurred during the rental period.
• Guests must return the vehicle in the same condition as received, with the same fuel level unless otherwise agreed.
• Guests must not allow unauthorized drivers to operate the vehicle unless an additional driver was registered at booking.
• Guests must not use the vehicle for commercial purposes, ridesharing, or delivery services without prior written consent from the Host.
• Guests must not transport illegal substances, engage in illegal activity, or take the vehicle off-road unless specifically permitted.
• Guests are responsible for excess mileage charges beyond the agreed daily allowance.

4. Host Responsibilities

• Hosts must ensure that listed vehicles are roadworthy, properly maintained, and meet all applicable safety standards.
• Hosts must maintain valid vehicle registration and insurance coverage as required by applicable law.
• Hosts must accurately represent their vehicles, including condition, mileage, and features.
• Hosts are responsible for disclosing any known mechanical issues, damage, or limitations of their vehicle prior to rental.
• Hosts must comply with all local, state, and federal laws regarding peer-to-peer vehicle rentals.

5. Insurance

IMPORTANT: RenToMyCar does not provide vehicle insurance. It is the sole responsibility of both Hosts and Guests to maintain appropriate insurance coverage.

• Guests who decline the optional protection plan must provide proof of personal auto insurance with comprehensive and collision coverage.
• Hosts are responsible for verifying that their personal auto insurance or a commercial policy covers peer-to-peer rentals. Many standard personal auto policies do not cover commercial use.
• The optional protection plans available at checkout are provided by third-party providers and are subject to their separate terms and conditions.
• RenToMyCar is not an insurance company and does not underwrite any insurance products.

6. Payments, Deposits & Fees

• All payments are processed securely through Stripe. RenToMyCar does not store payment card information.
• A refundable security deposit hold may be placed on the Guest's card at pickup and released upon satisfactory return of the vehicle.
• Excess mileage, fuel charges, cleaning fees, or damage costs may be deducted from the security deposit.
• RenToMyCar charges a service fee on each booking. This fee is non-refundable except where required by law.
• All prices are displayed in US Dollars (USD).

7. Cancellations & Refunds

Cancellation and refund policies vary by vehicle listing and are set by the Host (Flexible, Moderate, Strict, or Non-Refundable). The applicable policy is displayed on each car's listing page and during checkout. RenToMyCar's service fee is non-refundable in all cases. In the event of a dispute regarding a cancellation, RenToMyCar's decision is final.

8. Accidents and Damage

• In the event of an accident, Guests must immediately notify local law enforcement and obtain a police report.
• Guests must notify RenToMyCar and the Host of any accident or damage as soon as possible and no later than 24 hours after the incident.
• Guests are liable for all damage to the vehicle during the rental period, subject to any applicable protection plan coverage.
• Trip photos taken before and after each rental serve as evidence of vehicle condition and may be used in damage assessments.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. RENTOMYCAR DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. RENTOMYCAR MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE QUALITY, SAFETY, CONDITION, OR LEGALITY OF ANY VEHICLE LISTED ON THE PLATFORM, THE ACCURACY OF VEHICLE DESCRIPTIONS, OR THE CONDUCT OF ANY HOST OR GUEST.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RENTOMYCAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM OR ANY RENTAL TRANSACTION. IN NO EVENT SHALL RENTOMYCAR'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT PAID BY YOU TO RENTOMYCAR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless RenToMyCar, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from your use of the Platform, your violation of these Terms, or your interaction with any Host or Guest.

12. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law.
• Post false, misleading, or fraudulent content or listings.
• Circumvent the Platform to arrange rentals directly and avoid service fees.
• Harass, threaten, or discriminate against other users.
• Attempt to gain unauthorized access to our systems or another user's account.
• Use the Platform to transmit spam, malware, or harmful code.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in Dallas County, Texas, except where prohibited by applicable law. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Modifications to Terms

RenToMyCar reserves the right to modify these Terms at any time. We will notify users of material changes by updating the Effective Date and, where appropriate, by email. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
